§ 117-7. Setbacks and side yards.

  • (a)

    All residential structures and buildings hereafter constructed shall be setback from the side property lines not less than 20 feet. No residential structures need be set back more than 20 feet. No residential structure need by [be] setback more than the average of the setbacks of the existing structures within 100 feet each side thereof, but in no event closer than 25 feet from the road. The minimum setback from the rear property line shall be not less than 25 feet.

    (b)

    The minimum building setback requirements listed in subsection (a) of this section shall apply to all structures or buildings residential or accessory, which are permitted to be erected or constructed on a site. The distance shall be calculated from the nearest point of the structure or building, including all roof or deck overhangs, foundations, projecting elements (wall floor or roof assemblies). The minimum setback shall be measured from the structure to the nearest point on the property line or road right-of-way, but in no case shall the setback be less than 25 feet from the nearest edge of road pavement. The minimum required setbacks shall be as follows:

    Front ..... 25 feet

    Side ..... 20 feet

    Side Corner ..... 25 feet

    Rear ..... 25 feet

    (c)

    The minimum building setback requirements listed in subsections (a) and (b) of this section shall apply to all primary residential and accessory structures, which are permitted to be built, erected or constructed on the subject property. The setback distances shall be calculated from the nearest point of the structure or building, including but not limited to, all roof or deck overhangs; foundations; projecting elements; wall, floor, or roof assemblies; or any other element of the building or structure. The minimum setback shall be measured from the building or structure to the nearest point of the property boundary line or road right-of-way, but in no case shall the setback be less than 25 feet from the nearest edge of the road pavement.
