§ 50-41. Project initiation.

  • The mayor and council may approve the construction of new streets or the improvement of existing right-of-way under any or all of the following conditions:

    (1)

    If the owners of a majority of the parcels of land adjacent to condition 1 or condition 2 right-of-way as described in this article petition the mayor and city council to improve said right-of-way, describe in said petition the improvements desired to said right-of-way, it shall be the duty of the mayor and city council to proceed as provided in this article to cause the improvement to be made in accordance with the prayers set forth in the petition if deemed feasible and desirable by the mayor and city council in the exercise of its discretion. The petition shall be filed with the city clerk who shall investigate the sufficiency thereof, submit the petition to the mayor and city council, and certify the result of his/her investigation. The method of assessment for costs as well as the public hearing provisions and manner of payment for said improvement set forth in this article shall be followed in the completion of a citizen-initiated improvement project.

    (2)

    When funds are available and the mayor and council have determined that such street improvements are necessary.

    (3)

    When the county has agreed to perform the work and share in the cost of the same as provided by law.
