§ 2-31. Vacancy in council office.

  • (a)

    A vacancy shall exist if a city councilmember resigns, dies, moves his residence from the city or forfeits his office by being absent from five regular meetings of the mayor and city council within any consecutive 12-month period of time, with the exception of those unattended meetings for which the councilmember is excused by the granting of a leave of absence by a majority of the members of the city council and such leave of absence is entered on the minutes. A vacancy shall also exist if a councilmember is adjudged legally incompetent, or is convicted of malfeasance in office or of a felony.

    (b)

    The city council may vote, grant a leave of absence to a councilmember for each meeting not attended by the member. Notwithstanding the vote, the city clerk will record the member absent and adjust salary payments accordingly. The council shall vote within a period of time not exceeding 60 days from the date of absence, at a regular or called meeting of the mayor and city council.
